Preferential Investment Promotion Policy of Guangyuan City

GFF [2017] No. 44

Chapter 1      General Provisions

Article 1      According to spirits of Notice of the People's Government of Sichuan Province regarding Printing Opinions on Several Policies and Measures of Expanding Opening-up and Promoting the Investment (CFF [2017] No. 36) and Implementation Opinions of CPC Guangyuan Municipal Party Committee and Guangyuan Municipal People's Government regarding Advancing the Reform of Investment Promotion Mechanism (GFW [2017] No. 12), and in combination with our reality, this policy is hereby made.

Article 2      This policy is applicable to all investors who are involved in the investment in the manner of sole proprietorship, joint venture, equity participation, equity control, merger and acquisition, and etc., and conform to the encouraged and permissible projects in Catalogue of Industries for Guiding Foreign Investment, and projects in the Catalogue of Advantageous Industries for Foreign Investment in the Central and Western Regions and Catalogue of Industries Encouraged to Develop in the Western Region.

Article 3      The industrial projects cultivated and developed by various counties or districts and Guangyuan National Economic and Technical Development Zone according to the "13th Five-Year" Industrial Layout Plan of Guangyuan City, and the industrial projects introduced within the planning scope of Sanjiang New Area, are applicable to this preferential policy.

Chapter 2      Industrial Development Direction

Article 4      Industries Particularly Encouraged for Development

(i)   Strive to develop five major featured advantageous industries, namely, foods & drinks, biological medicine, clean energy & chemical industry, machinery & electronics, and new materials, and achieve the breakthrough development in strategic emerging industries and military and civilian integrated industry.

(ii)  Encourage the rapid development of ecological healthcare, integrated eldercare services with medical care, cultural tourism, modern logistics, e-commerce, modern finance, and other emerging leading service industries.

(iii) Encourage to energetically develop the modern agriculture, furniture industry, deep processing of agriculture products and by products and other green, low carbon and environmental protection industries by utilizing the mountains, rivers, forest lands, countryside and other natural endowments functions;Develop the tourism projects by utilizing the waste lands, waste slopes, desolate sands, abandoned mines, and other lands.

(iv) Encourage the innovation & entrepreneurship, and the establishment of significant scientific and technical innovation platform and service platform, and promote the conversion of scientific and technical innovation and scientific and technical results.

Chapter 3      Preferential Policy

Article 5      Tax Policy

Execute the VAT threshold policy according to the upper limit specified by the state, and incorporate into the deduction scope the VAT of newly added corporate VAT that conforms to the policy regulation. Properly implement the tax preferential policies for enterprises for development of the western region in China, high-tech enterprises and small low-profit enterprises; Implement various tax preferential policies for poverty alleviation-oriented donations, employment and entrepreneurship, enabling all taxpayers to fully enjoy these policies.The enterprise-related charging of government departments shall implement the inventory management. If any cancellation, termination, combination, and reduction of standard charging is announced, it shall be executed strictly as per the time nodes.If there are both upper and lower limits for the charging standards, all charges shall be collected according to lower limit standards.The provincially set administrative charges paid by enterprises shall implement the "zero charging" policy, except that the civil air defense works relocation construction costs implement the inventory management system. For the newly established industrial enterprises, and low-profit enterprises, the "zero charging" policy within the scope of administrative power but beyond the inventory management system will be implemented.

Article 6      Incentive Policy

(i)   Establish the incentive mechanism for the import of significant projects.Establish the appropriate scale of special funds, and adopt the investment subsidy, investment rewards, discount loan, equity incentive, equity conversion, R & D subsidy, equipment subsidy, logistics subsidy, training funding, employment and social security subsidy and other methods, supporting the introduction of significant industrial projects.For the industrial projects with the fixed assets investment amount of more than RMB 10 million, if the construction investment is completed within the agreed deadline, the financial department at the same level will arrange the funds rewards according to its contribution to the local finance on the same year of its commissioning and based on the following proportions: 100% in the 1st ~2nd year, and 50% in the 3rd~5th year.The agricultural industrialized project with the investment amount of RMB 5~50 million (exclusive) and service project with the investment amount of RMB 10 million~100 million (exclusive) may enjoy such preferential policy.For the extra significant industrial project with the investment amount of more than 500 million, and the significant transportation infrastructure project with the investment amount of RMB 1 billion and above, the support policy may be made according to the "one discussion for one case" principle and implemented after being approved by the municipal people's government.The counties or districts, and Guangyuan National Economic and Technical Development Zone will set the appropriate scale of special funds in combination with its own financial status, supporting the development of introduced industrial projects.

(ii)  Encourage migrant workers and farmer-turned-entrepreneurs to start a business by returning to hometown.If it is confirmed that the municipal-level migrant workers and farmer-turned-entrepreneurs start a business by returning to hometown, the RMB 500,000 financial subsidy will be provided. The migrant workers and farmer-turned-entrepreneurs who start a business by returning to hometown, may enjoy the entrepreneurship secured discount loan policy.If the new agricultural businesses established by migrant workers and farmer-turned-entrepreneurs who return to the hometown, conform to the agricultural subsidy policy, they may equally enjoy the corresponding policy support according to the specifications.The entrepreneurs and rural entrepreneurial leaders who have achieved significant effects in contribution to the local poverty alleviation and industrial development, shall enjoy the fiscal, tax, financial and other supports, and the comprehensive preferential policy will be given to them according to the "one policy for one enterprise" principle. If the enterprise newly recruits university graduates who have been graduated for no more than 2 years, signs a labor contract of at least one year and pays the social security fees, it will be given one-year social security subsidy.

(iii)Encourage the technical innovation.Strengthen the support to innovation platforms.For the newly identified national enterprise engineering technical research center, technical development center, national-local joint laboratory, engineering laboratory, key laboratory and other national innovation platforms, the RMB 500,000 rewards will be given.The award of RMB 150,000 will be given for the newly identified provincial innovation platforms such as provincial enterprise engineering technology research center, engineering laboratory, key laboratory, industrial technology research institute and enterprise technology center.The subsidy of RMB 100,000 will be given in a lump sum for newly identified city-level enterprise engineering technology research center, technical center, key laboratory, R&D center, center for transformation of scientific and technological achievements, industrial technology research institute and industrial technology innovation alliance.The subsidy of RMB 200,000 will be given in a lump sum for the newly identified academician (expert) workstation.The subsidy of RMB 100,000 will be given respectively for successfully established national high-tech enterprises, enterprises implementing national intellectual property standards, demonstration enterprises and competitive cultivation enterprises.The subsidy of RMB 50,000 will be given respectively for provincial innovative enterprises, provincial intellectual property demonstration enterprises and competitive cultivation enterprises.

(IV) Encourage mass entrepreneurship.For young entrepreneurs or teams who have settled in mass entrepreneurship space, science and technology incubators and industrial accelerators, innovation and entrepreneurship park (incubation base) subsidies will be provided. For the innovation & entrepreneurship platforms and innovation & entrepreneurship parks (incubation bases), those providing free incubation services and giving preferential rent for college graduates' entrepreneurship projects will be given an incubation subsidy of no more than RMB 5,000 for every entrepreneurship project successfully incubated.The special fund of RMB 100,000-500,000 will be granted for the incubators in national and provincial high-tech zones and key incubators in the city.Except the provincial support, the special fund of RMB 200,000-300,000 will be granted for the newly identified national and provincial incubators.

(V) Encourage tourism brand creation.For national tourism brands such as new five-star hotels, national resort areas and 5A tourist attractions, the enterprise income tax paid from the approval to the review period shall be awarded to the enterprise in full by the municipal finance department.The 50% of enterprise income tax paid will be rewarded by the municipal finance department within three years after the review.

Article 7      Economic Development Policy of Headquarters

Encourage the development of headquarters (base) project.Focus on supporting the introduction of functional headquarters (base) projects in line with our city's industrial development orientation, such as investment, R&D, sales, logistics and finance, and give comprehensive preferential support according to “one enterprise and one policy”.For the newly established and verified headquarters enterprises, from the year they move in, the beneficiary finance will give a reward of 100% of the local retained part in the previous two years, and give a reward of 50% of the local retained part in the last three years according to their contribution to local financial resources that year. For the core senior management talents of the headquarters enterprises, the award and support will be given according to Ten Measures of Special Support for Innovation and Entrepreneurship Talents in Guangyuan City. Where the headquarters enterprises hold conferences and exhibitions on a provincial or above scale and sponsored by national trade associations in Guangyuan, the highest reward of RMB 1 million will be given according to the number of participants in the conference, exhibition, exhibition scale and the effect of the conference and exhibition.The key economic projects of the headquarters with strong driving force and great contributions to local economic development shall be supported separately after being examined and approved by the Municipal Investment Promotion Board and submitted to the municipal government for approval.

Article 8      Development Policy of Export-oriented Economy

Guangyuan City shall encourage enterprises to actively participate in international market competition, integrate the special funds for the development of foreign trade and economies at the higher level and the special funds for trade service industry arranged by the municipal finance department. In the aspects of foreign trade enterprises achieving self-support export, production-oriented foreign trade enterprises participating in international market competition, trade enterprises playing a comprehensive service role, and foreign trade enterprises becoming bigger and stronger, the support shall be given in accordance with the policies passed at the 24th Executive Meeting of the seventh Municipal People's Government.Guangyuan City shall further enhance the use of foreign investment, strengthen the introduction of export-oriented terminal manufacturing, modern agriculture, modern service industry, strategic emerging industries and the World's Top 500 companies, support foreign companies to increase their capital and promote the transformation and upgrading of traditional industries through innovative ways of foreign investment such as mergers, acquisitions and equity investment.Where foreign investors are introduced to invest in our city, for the projects with over USD 1 million (inclusive) of foreign investment available in the current year, the first introducer or enterprise will be awarded RMB 0.03 for every USD 1, and the maximum reward for a single project shall be not more than RMB 300,000.

Article 9      Development Policy of Modern Service Industry

(i)Guangyuan City should increase the amount of special funds for the service sector, support key areas such as independent innovation and brand building, and accelerate the construction of service industry clusters like modern logistics, cultural tourism, trade fairs, scientific and technological information, and education.It should support local governments to provide appropriate logistics subsidies for key industrial enterprises in light of their actual conditions so as to reduce their logistics costs.Support and subsidies shall be given to commercial circulation, supply and marketing, postal services and express delivery enterprises for setting up service outlets in poverty-stricken areas.

(ii)Where a service enterprise established separately from the main and auxiliary components of the manufacturing industry conforms to the conditions for small micro-profit enterprises, and the annual taxable income is less than RMB 500,000 (inclusive) from January 1, 2017 to December 31, 2019, the income shall be deducted by 50% into the taxable income amount, and the enterprise income tax shall be levied at the tax rate of 20%. E-commerce enterprises should be encouraged to participate in the identification of various qualifications and those meeting the conditions can enjoy relevant preferential tax policies. Service enterprises should be encouraged to become bigger and stronger, and a reward of RMB 5,000 should be given to each service enterprise newly added in the library.

(iii)Open up the health services market. Examination and approval procedures for industrial and commercial registration, practice registration, and designated medical insurance should be simplified. The planning, layout and land use guarantee should be strengthened for the health service industry, and the land used by non-profit organizations should be given priority.Non-public medical institutions use water, electricity, gas and heat at the same price as public medical institutions. Endowment institutions use electricity, water, gas and heat at the same price as the living prices of residents.Relevant administrative charges shall be exempted for the construction of non-profit medical institutions and nursing institutions for the aged. Relevant administrative charges shall be halved for the construction of for-profit medical institutions and nursing institutions for the aged. Relevant administrative charges shall be halved for the nursing institutions for the aged providing services for the aged. Domestic and foreign capital holding the nursing institutions for the aged should enjoy the same preferential policies.

(iv) Actively expand the scale of market consumption. It is required to continuously implement the incentives of Guangyuan City for wholesale, retail, accommodation and catering enterprises to become bigger and stronger. It is required to implement the subsidy policy for the enterprises participating in “Sichuan goods going nationwide” and “actions of benefiting people in shopping all over Sichuan”, carry out special promotion activities for “made-in-Guangyuan” products in some cities of northwest region, and give the publicity expenditure subsidy of RMB 10,000 for the enterprises organizing large-scale promotion activities such as “shopping month for the new year”, and the promotion activities during National Day and Spring Festival.

Chapter 4      Factor Support Policy

Article 10    High-level Talent Introduction and Enterprise Employment Policy

(i) Attract high-level innovative and entrepreneurial talents. For six types of high-level talents who innovate and start up business in Guangyuan, including academicians of Chinese Academy of Sciences, engineering academicians, chief scientists, finalists of national and provincial “Recruitment Program of Global Experts”, doctoral candidates and postgraduates, RMB 3 million, RMB 1 million, RMB 500,000, RMB 150,000 and RMB 80,000 should be given respectively in a lump sum as the settlement allowance.Job subsidies of RMB 10,000, RMB 5,000, RMB 3,000, RMB 1,000 and RMB 500 should be granted monthly, with the period of 5 years.For the innovation and entrepreneur teams introduced through provincial “Recruitment Program of Global Experts”, the subsidy of RMB 2 million-5 million should be given.Meanwhile, “green channel” should be provided in terms of spouse employment, child education, social provision for the aged and medical security. If the spouse is a civil servant or a staff of a public institution, the post may be transferred according to the spouse’s will, and the post or position should be properly arranged.

(ii) When an enterprise introduces excellent professional talents, the resettlement subsidy shall be applied by the employer. According to the principle of territorial management, the Talent Office should examine preliminarily. After the leading group for talent work and the government examine and approve, 30% of settlement subsidy should be granted by the finance department at the same level.

(iii)The key support should be given for jobs (types of work) that are closely related to the development of local key pillar industries and are in urgent need, and the training subsidy standard should increase. Enterprises should be encouraged to carry out various forms of training to improve workers' skills. Direct subsidies shall be given to the enterprises which carry out the "fixed-order" training for newly recruited personnel and obtain corresponding professional qualification certificates. Direct subsidies shall be given to the enterprises which carry out job-transfer training for skilled workers to improve their skills and learn new technology, new process and new materials and obtain corresponding qualification certificates. Local governments should be supported to carry out entrepreneurship training and vocational skills training according to industrial development and the needs of workers, and entrepreneurship training subsidies and vocational skills training subsidies should be provided to those meeting the requirements.

(iv) The rate of "five social insurances and one housing fund" rate should be reduced by stages according to the regulations. The payment rate of basic pension insurance should be uniformly reduced to 19% and the rate of unemployment insurance in the city should be reduced to 1%. Besides, it is required to standardize and periodically reduce the deposit proportion of enterprise housing fund. The deposit proportion of housing fund deposit shall not exceed 12%.

Article 11    Investment and Financing Policies

(i)Encourage foreign-invested enterprises to carry out shareholding reform, support listing on the Fourth Board and the New Third Board or on the main board, SME board and Growth Enterprise Market, and achieve direct financing through bond issuing. The preferential policy should be executed according to the Notice of Guangyuan Municipal People's Government on Financing Preferential Policies for Enterprises Listing (GFF [2017] No.16).

(ii)Increase indirect financing support for foreign-invested enterprises. Guide financial institutions to innovate in financial products, optimize the approval procedures, implement new financing models such as pledge of accounts receivable and pledge of intellectual property rights, provide more flexible forms of guarantee and loan renewal, and enhance credit support for investment projects. Support eligible tourism enterprises to issue short-term financing bonds, corporate bonds and medium-term notes.

Article 12    Land Use Guarantee Policy

(i)The land use plan for major industrial projects may be partially adjusted in accordance with regulations, provided that basic farmland is not occupied. The priority should be given to major projects for the annually increased land for construction. One appointment, planning, reservation and land supply by stages should be implemented. The special preferential measures should be adopted for the industries encouraged by the state and the key enterprises introduced by the province and the city to use land in the form of "one case, one discussion".

(ii)Encourage parks to revitalize existing land. The land transfer fee shall be no longer collected for the parks with the two-storey and multi-storey factory buildings centrally planned and for the construction land on which the area of the factory buildings and the land plot ratio increase.Where foreign invested enterprises utilize existing factory area and factory buildings for transformation and construction, under the premise of conforming to the planning and not changing the nature of industrial land, the plot ratio should increase and the land transfer fee should be be exempted.

(iii)The flexible transfer period of newly-added industrial land shall be implemented, and the determined transfer period of general industrial land is 10 years, 20 years, and 30 years, respectively. The enterprises are encouraged to use state-owned building land by leasing; and the industrial land complying with the prescribed industry directory is supplied in the form of "leasing before transfer".


(iv)Transfer price of unused industrial land could be set at the minimum price, in the range of 10%-50% of the National Lowest Price Standard for Transfer of Industrial Land. Priority is given to the supply of land for the encouraged industrial project with intensive land. The base price of land transfer could be set at the minimum of 70% of the National Lowest Price Standard for Transfer of Industrial Land per the grades of land where the project is located.

(v)According to the industrial policies and project categories, industrial land can be provided in various ways, such as leasing, leasing before transfer, combination of leasing and transferring, and transfer of differentiated years. Public service projects that are jointly invested by foreign capitals and government and use the allocated land, such as medical care, pension, education, culture and sports projects, can be provided with land in such a way that state-owned construction land is invested at the fixed price or by shares.

(vi)The enterprises shall be encouraged to conduct capital increase and production expansion. Those who obtain industrial and storage land by means of transfer and are required to report for the construction land of new buildings due to capital increase and production expansion will be exempted from land price for the part of the increased productive building area exceeding the plot ratio of 1.0.

(vii)Those who use the stock industrial property to develop productive services and set up such crowd-creation spaces as maker space and innovation plants can continue to use the land according to the original purpose and type of land rights within 5 years. The enterprises with the expiration of 5 years or transfer involvement can be handled by an agreement according to new use, new right type, and market price if required for handling relevant land use procedures. The holder with the right to use industrial land is allowed to redevelop the land in accordance with relevant regulations after approval by the municipal and county people’s governments.

(viii)After the investment promotion enterprises provide 15%-20% of the budgeted cost of the standard plant for key encouraged industries in accordance with the needs of investment promotion projects, the investment promotion entities can build the standard plant on behalf of the enterprises. The investment promotion enterprises purchase the standard plant within 5-10 years according to the investment agreement.

Article 13    Water, Electricity and Gas Policy

The support for electricity price in key industries such as high technology, cultural tourism, and key areas and parks shall be increased to further reduce the cost of electricity for the entity economy. Eligible investment enterprises in Guangyuan will comply with the policies of provincial direct-purchasing power and wet-season surplus electricity. The gas utilization cost of enterprise shall be reduced; and the supply channels of natural gas shall be broadened. The conditions for pipeline gas supply shall be created for industrial parks and large natural gas users with a daily gas consumption of 30,000 cubic meters or more, to achieve as much as possible from "transfer supply" to direct supply. The gas supply of enterprises in the parks shall be changed from "transfer supply" to "direct supply." Priority will be given to ensuring the demand for production factors such as water, electricity, and gas for major projects, which can be provided with price subsidies by governments at all levels.

Article 14   Other Policies

(i)For strategic emerging industries and high-growth technological innovation enterprises, as well as projects with strong clustering and industrial driving effects, advanced equipment for the transformation and upgrading of traditional industries, large investment scale, outstanding social contribution and total planned investment above RMB 1 billion, they shall be given a key support in accordance with the ways of "one enterprise along with one policy" and "one matter along with one discussion".

(ii)The ecological rehabilitation tourism industries shall be vigorously developed to give full play to the advantages of forest ecological resources; natural education, scientific exploration, forest experience, forest rehabilitation, forest bathing and other forest rehabilitation tourism products shall be exploited; and the cultivation and development of market entities in cultural and creative industries as well as tourism industry shall be accelerated. The administrative charges paid by tourism enterprises and tourism projects shall be charged according to the lowest standard if clearly stipulated in charging standards.

Chapter 5      Service Assurance

Article 15    Vigorous Promotion of "Internet + Government Services" Along with Active Promotion of Online Approval.An investment promotion agency shall be established, and key investment projects shall be incorporated into the "green channel" of public service, with free services throughout the process.On the basis of the legal time limit, the handling rate will be increased by more than 60%. Planning, land, environmental protection and other departments will intervene in project services in advance, and give priority to the formalities involved in the governance scope, and relevant departments will assist in handling national and provincial formalities.

Article 16    Establishment of audit mechanism for key projects. The Municipal Investment Promotion Board will irregularly conduct centralized audits on major issues such as land, planning, environmental protection, financing, water, electricity, gas, and fire control that are involved in the promotion of key projects according to needs, implement responsibilities, and complete them within a limited time.

Article 17    Establishment of Mechanisms to Review Investment Project and Supervise Contract FilingThe process of signing investment promotion agreements shall be standardized; review mechanism for project signature, commencement of works and policy implementation shall be established; review content and process shall be standardized, and review file management shall be strengthened. After the signature of the investment promotion project, the contract shall be reported to the same-level investment promotion department for the record. Investment Promotion Department, in conjunction with Supervision Department, will regularly track and supervise commitments made by government and enterprise in the contract, so as to promote their timely fulfillment.Accountable entities without handling government's commitments as agreed in the contract shall be announced or held accountable.

Article 18    Establishment of Fault-tolerant and Correction Mechanism for Investment PromotionIn the event of the adjustment to major national policies or unclear policies during the investment promotion, negligence or mistakes that are not transferred from individual will, comply with the decision-making procedures, do not involve in personal gains and subjective intentions, shall not be held accountable.

Chapter 6      Policy Enforcement

Article 19    Enforcement EntityPreferential policies will be enforced in the county or district and Guangyuan National Economic and Technical Development Zone where the project is located and based on the promise of "beneficiary shall assume corresponding responsibility".

Article 20 Enforcement ProcedureThe enterprises shall file an application to the local county and district governments and the Management Committees of Guangyuan National Economic and Technical Development Zone, and the counties, districts and developing zones will fully fulfill it after the review and approval. The counties, districts and developing zones shall file an application for municipal commitment rewards, which are uniformly enforced after review and approval by the Municipal Investment Promotion Board.

Article 21    Enforcement TimeThe preferential policy rewards will be declared in the first quarter of the following year, and redeemed in the second quarter after review and approval by the Municipal Investment Promotion Board.

Chapter 7      Supplementary Provisions

Article 22    For foreign-invested enterprises or individuals enjoying the preferential policies, the operating period of their establishment in our city shall not be less than 10 years from the date of enjoying the policy. Newly established headquarter enterprises audited and certified are not allowed to move out of the locality within 5 years after enjoying the incentive and subsidy policies.

Article 23    If the state or province provides otherwise in respect of the above, such provisions prevail.In the event of adjustment to major national or provincial policies, such provisions prevail.If the policies are overlapping with other national or provincial rewards and preferential policies, the principle of following high rewards instead of repeated enjoyment of rewards shall be adopted.

Article 24    The management system of the negative list of enterprise investment shall be strictly implemented. If the settled enterprises cause serious environmental illegality during their operations, are punished by relevant departments and severely evade taxes, the cancellation of preferential benefits or rewards enjoyed by the enterprises and the recovery of the enjoyed preferential policies or rewards shall be conducted.


Article 25    On the premise of seeking balance of financial resources, preferential policies can be formulated in all counties and districts as well as Guangyuan National Economic and Technical Development Zone based on the policies, to encourage industrial projects attracted by Lizhou District, Zhaohua District and Guangyuan National Economic and Technical Development Zone to be centrally arranged in Sanjiang New District.

Article 26    The preferential policies shall be enforced from the release date, with the validity period of 5 years. The Municipal Investment Promotion Board has the right to interpret the preferential policies.

Article 27    If Opinions on Vigorously Promoting Undertaking of Industrial Transfer by Guangyuan Municipal People’s Government of the CPC Guangyuan Municipal Committee on August 9, 2008 (GWF [2008] No. 7) are inconsistent with the preferential policies, such policies shall prevail.
